These Terms of Use (“Terms”) are a legal agreement between you and Nitronet (“Nitronet”, “we”, “us”, “our”) covering the Nitronet Android app, the Nitronet VPN service, and nitronet.app (together, the “Service”). Please read them before using the Service.

Acceptance of these Terms

By installing, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and “you” includes it.

Eligibility

You must be at least 18 years old to use the Service. The Service is not directed to children, and we do not knowingly allow anyone under 18 to use it. You must be legally able to enter into this agreement and must not be barred from using the Service under the laws that apply to you.

We may restrict availability in regions where providing the Service would be unlawful or unsafe. You are responsible for complying with local law when you use a VPN.

The Service

Nitronet is a free, ad-supported VPN for Android. It creates an encrypted tunnel between your device and a Nitronet server, and sends your internet traffic and DNS through that tunnel.

  • No account. The app uses a pseudonymous device identity. There is no sign-up, password, or profile.
  • No usage quota. There is no data cap. Capacity controls and rate limits still apply to protect the service.
  • Free plan. The free plan includes automatic location selection and is funded by one adaptive banner on the Home screen. There are no forced full-screen ads, no app-open ads, and no ads injected into your traffic.
  • Nitronium. Nitronium is an optional subscription bought through Google Play. It removes ads, unlocks all locations, and gives priority when a location is busy. Plan length and price are shown in the app before you confirm.

We may improve, change, or retire features. We do not guarantee any particular speed, server, location, protocol, or feature.

Nitronium subscriptions

Nitronium is sold and billed by Google Play, not by Nitronet directly.

  • Payment is charged to your Google Play account when you confirm the purchase.
  • Subscriptions renew automatically unless you cancel before the renewal date in your Google Play subscriptions settings.
  • The price, billing period, and any trial terms are shown before purchase. We do not add hidden charges.
  • Refunds and billing disputes are handled under Google Play’s policies. We can help you locate the right process but cannot issue Google Play refunds ourselves.
  • If a purchase cannot be verified, premium features may be unavailable until it is resolved.
  • Cancelling stops future renewals. Access normally continues until the end of the paid period, as Google Play determines.

Using the Nitronium features does not give you ownership of them, and entitlements are personal and non-transferable.

Licence

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own lawful use.

You may not:

  • copy, sell, rent, sublicense, or redistribute the app or access to the Service;
  • reverse engineer, decompile, or attempt to extract source code, except where the law expressly permits it;
  • remove or alter proprietary notices;
  • use the Service to build a competing product from non-public parts of it;
  • access the Service through automated means except as we permit.

Acceptable use

You agree not to use the Service to:

  • break the law or help anyone else break it;
  • harm, threaten, harass, defraud, or impersonate anyone;
  • send spam, distribute malware, or run phishing or botnet activity;
  • attack, scan, overload, or gain unauthorised access to any system, including ours;
  • interfere with the Service, other users, or the networks it connects to;
  • infringe intellectual-property, privacy, or other rights;
  • distribute child sexual abuse material or content that is illegal;
  • evade lawful sanctions, court orders, or lawful investigations;
  • resell, share, or transfer access commercially without our written permission;
  • circumvent rate limits, capacity controls, availability restrictions, or security measures;
  • use the tunnel in a way that exposes Nitronet or its providers to legal liability.

We may investigate suspected abuse and suspend or terminate access where we reasonably believe these rules have been broken. Where appropriate and lawful, we will tell you why.

Availability and changes

The Service is provided on an “as available” basis. It may be interrupted by maintenance, network conditions, server capacity, restrictions in your region, or events outside our control. We do not promise uninterrupted, error-free, or always-available service, and we do not promise specific speeds or that any particular site or service will work.

Availability may vary by region. You are responsible for knowing whether VPN use is lawful where you are.

We may change, suspend, or discontinue the Service or any part of it. If we discontinue a paid feature you have purchased, we will handle it in line with applicable consumer law and Google Play’s policies.

Third-party services

The Service relies on third parties, including Google Play for distribution and billing and Google AdMob for advertising. Their terms and privacy policies apply to their parts of the experience. Nitronet does not control those services and is not responsible for them.

Links to third-party sites are provided for convenience. Following them is at your own risk.

Privacy

Our Privacy Policy explains what data we collect, why, how long we keep it, and how to exercise your rights. It forms part of these Terms. Key points: there are no accounts, we do not log browsing history, DNS query names, or destination IPs, and we keep limited connection metadata for routing and abuse prevention.

Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.

We do not warrant that the Service will be secure, uninterrupted, timely, accurate, or free of errors, that defects will be corrected, or that the Service will protect against every threat. A VPN reduces exposure; it does not make you anonymous or invulnerable. Nothing in these Terms excludes warranties or rights that cannot be excluded under the law that applies to you.

Limitation of liability

To the maximum extent permitted by law, Nitronet and its operators, contributors, and suppliers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to the Service or these Terms, even if we were advised of the possibility.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service is limited to the greater of:

  1. the amount you paid Nitronet for the Service in the 12 months before the event giving rise to the claim; or
  2. USD 20.

Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be limited by law. If you are a consumer, you keep the benefit of mandatory consumer protections in your country of residence.

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Nitronet from claims, damages, liabilities, and reasonable costs arising from your breach of these Terms or your misuse of the Service. This does not apply to the extent the claim results from our own negligence or breach.

Suspension and termination

You may stop using the Service at any time by disconnecting and uninstalling the app. Uninstalling does not automatically cancel a Nitronium subscription; cancel it in Google Play.

We may suspend or terminate your access if you materially breach these Terms, abuse the Service, create a security or legal risk, or if we are required to by law. Where practical, we will give notice and a chance to remedy the issue. We may also suspend service for maintenance or capacity reasons.

Sections that by their nature should survive termination — including licence restrictions, disclaimers, limitation of liability, indemnity, and governing law — continue to apply.

Governing law and disputes

These Terms are governed by the laws of the country in which the Nitronet operator is established, without regard to conflict-of-law rules. The courts of that country have jurisdiction, subject to any mandatory rules that give you the right to bring a claim in your country of residence.

If you are a consumer in the EEA or the UK, nothing in this section removes the protection of mandatory consumer law in your country, including your right to use local courts or alternative dispute-resolution bodies where the law provides it.

Before starting formal proceedings, please contact hello@nitronet.app so we can try to resolve the issue.

Changes to these Terms

We may update these Terms as the Service or the law changes. The effective date, last-updated date, and version at the top of this page show the current edition. For material changes we will provide notice in the app or on this website before they take effect. Continued use after the effective date means you accept the updated Terms. If you do not agree, stop using the Service.

General

  • Severability. If a provision is found unenforceable, the rest remains in effect.
  • No waiver. Failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or reorganisation.
  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Nitronet about the Service.
  • Language. These Terms are written in English. Translations, if provided, are for convenience; the English version controls where the law allows.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
